LITIGATION – CIVIL & CRIMINAL

“The Code of Civil Procedure, 1908” governs the civil conflicts, whereas “The Code of Criminal Procedure, 1973” governs the criminal proceedings. “The Evidence Act of 1872” contains the Rules of Evidence. The parties' substantive rights will be governed by the relevant substantive acts passed by the Parliament and/or state legislatures applicable to the case, such as the “Transfer of Property Act, 1882, “The Contract Act, 1872, or “The Indian Penal Code, 1860, in addition to the procedural and evidentiary rules.
